For decades, Frontiers of Freedom has supported policies that expand access to affordable, abundant, and reliable energy for all Americans. President Trump’s focus on, and the United States’ broader shift toward, natural gas has been central to achieving that goal, delivering lower costs and greater energy security nationwide. Under President Trump’s leadership, regulatory barriers to energy production were rolled back and domestic energy exploration was encouraged – steps that have already driven down energy prices for consumers in meaningful ways.
Unfortunately, a lawsuit originating out of Texas now threatens to undermine these gains and reimpose higher costs on Americans across the country. In November 2024, eleven Republican attorneys general – including Alabama Attorney General Steve Marshall – filed a lawsuit alleging that major asset managers used their investments in coal companies to pressure the industry into reducing output. The lawsuit claims that asset managers – through participation in climate initiatives – colluded to restrict coal supply, thereby driving up energy prices.
Rather than protecting consumers, this lawsuit risks harming them. While Frontiers of Freedom agrees that political activism should not dictate investment decisions, the decline in coal production was already well underway, driven by the simple reality that natural gas had become the more cost-effective energy source.
Attorney General Marshall and the other attorneys general involved in this lawsuit must consider the broader consequences of their actions. U.S. electricity consumption is projected to reach new record highs in 2026, with the U.S. Energy Information Administration (EIA) forecasting a 1.7% to 2% annual growth rate after 2025 records. President Trump’s commitment to common-sense energy policies that promote competition, stability, and American energy dominance will continue to lower costs for consumers. This lawsuit moves the country in the opposite direction.
